These Terms of Service (“Terms”) govern your access to and use of roadiemerch.com and any purchase made through the website.

The website and Roadie Merch brand are operated by 230 Management Inc. (“Roadie Merch,” “we,” “us,” or “our”).

By visiting the website, creating an account or purchasing a product, you agree to these Terms. If you do not agree, do not use the website.

1. Eligibility

You must be at least the age of majority in the place where you live to make a purchase. If you are not, you may use the Services only with the involvement and permission of a parent or legal guardian.

You agree to provide accurate, current and complete information when placing an order or creating an account.

2. Products and availability

We make reasonable efforts to display product descriptions, sizes, colours, artwork and images accurately. However:

• Colours may appear differently depending on your screen.
• Garment measurements may have reasonable manufacturing tolerances.
• Print placement, colour and appearance may vary slightly between production runs.
• Product packaging may differ from images shown.
• Product availability may change without notice.

These normal production variations do not necessarily indicate a defect.

We may modify, discontinue or limit the availability or quantity of a product at any time.

3. Made-to-order products

Many Roadie Merch products are made after an order is placed. We use independent production and fulfillment partners to manufacture, package and ship these products.

Because production can begin quickly, requests to change or cancel an order are not guaranteed. Contact us as soon as possible if you notice an error.

Please review product descriptions and sizing information carefully before ordering.

4. Orders

Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges that we received the order but does not necessarily mean the order has been accepted.

We may decline, limit or cancel an order because of:

• Product or material availability.
• Pricing or product-information errors.
• Suspected fraud, unauthorized activity or misuse.
• Shipping restrictions.
• An inability to fulfill the order.
• A violation of these Terms.

If we cancel an order after payment has been processed, we will issue the appropriate refund to the original payment method.

Products are intended for personal use unless we have agreed otherwise in writing. You may not place orders for unauthorized resale or commercial distribution.

5. Prices, taxes and payment

Prices may be displayed in different currencies depending on your location. The amount, currency, taxes and shipping charges shown at checkout govern your purchase.

International customers may be responsible for customs duties, import taxes, brokerage charges or other fees imposed by their country. Please review our Shipping & Delivery Policy for additional information.

We may correct pricing or product-information errors before accepting an order. If an error affects an order already submitted, we may contact you for instructions or cancel and refund the order.

Payment services are provided by Shopify and third-party payment processors. You authorize them to charge the payment method selected at checkout.

6. Shipping and delivery

Shipping methods, production estimates, delivery estimates, address responsibilities, international delivery information and lost-package procedures are described in our Shipping & Delivery Policy, which forms part of these Terms.

Production and delivery dates are estimates, not guarantees. Delays may occur because of carrier disruptions, weather, customs, supply shortages, high order volume or circumstances outside our reasonable control.

Orders containing multiple products may arrive in separate packages.

You are responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect, incomplete or undeliverable address may be charged where permitted by law.

7. Returns, replacements and refunds

Returns, exchanges, damaged products, incorrect items and refund eligibility are governed by our Refund Policy, which forms part of these Terms.

Nothing in these Terms or our policies limits a statutory consumer right that cannot legally be waived.

8. Customer accounts

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.

Notify us promptly if you believe your account has been accessed without authorization. We may suspend or close accounts associated with fraud, misuse or violations of these Terms.

9. Intellectual property

The Roadie Merch name, logos, artwork, product designs, photographs, graphics, text, slogans, website layout and other content are owned by or licensed to Roadie Merch and are protected by intellectual-property laws.

You may access the website for personal, non-commercial shopping purposes. Without written permission, you may not:

• Copy, reproduce, modify or distribute our artwork or content.
• Manufacture or sell products using our designs.
• Use our name, logo, product images or slogans commercially.
• Remove copyright, trademark or ownership notices.
• Scrape, harvest or systematically extract website content.
• Suggest an affiliation with or endorsement by Roadie Merch that does not exist.

10. Reviews and customer submissions

If you submit a review, photograph, comment or other content directly to Roadie Merch, you confirm that:

• You created it or have permission to submit it.
• It does not violate another person’s rights.
• It is not unlawful, misleading, defamatory or malicious.

You retain ownership of your content. By deliberately submitting it for publication, you grant Roadie Merch a non-exclusive, worldwide, royalty-free licence to display, reproduce and adapt that content for operating and promoting Roadie Merch.

We will not claim ownership of private customer-service messages merely because you contacted us.

11. Prohibited uses

You may not use the Services to:

• Violate a law or another person’s rights.
• Submit false, fraudulent or unauthorized orders.
• Transmit malicious code or attempt to compromise website security.
• Interfere with the operation of the Services.
• Access accounts or systems without authorization.
• Collect personal information about others without permission.
• Impersonate another person or misrepresent your identity.
• Engage in automated scraping or abusive traffic.
• Harass, threaten or harm another person.

We may restrict access or cancel orders associated with prohibited conduct.

12. Third-party services and links

We rely on third parties, including Shopify, payment processors, production partners and shipping carriers, to provide parts of the Services.

Third-party websites, applications and services may have separate terms and policies. To the extent permitted by law, Roadie Merch is not responsible for third-party services that are outside our reasonable control.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy.

14. Disclaimer of warranties

We aim to provide accurate information and quality products. However, except for warranties or consumer rights that cannot legally be excluded, the website is provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free or free from every harmful component. Temporary outages, maintenance and technical errors may occur.

Nothing in this section excludes an express product promise made by Roadie Merch or a right available under applicable consumer-protection law.

15. Limitation of liability

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, willful misconduct, gross negligence, or death or personal injury where such a limitation is prohibited.

To the maximum extent permitted by law:

• Roadie Merch will not be liable for indirect, incidental, special, punitive or consequential loss arising from use of the Services or a purchase.
• Roadie Merch’s total liability relating to a particular order will not exceed the amount paid for that order.

Some jurisdictions do not permit certain limitations, so part or all of this section may not apply to you.

16. Indemnification

To the extent permitted by law, you agree to indemnify Roadie Merch against claims, damages or reasonable costs arising directly from your unlawful use of the Services, violation of these Terms or infringement of another person’s rights.

This section does not apply to losses caused by Roadie Merch or responsibilities that cannot legally be transferred to you.

17. Events outside our control

We are not responsible for delays or failures caused by circumstances reasonably outside our control, including severe weather, carrier disruptions, customs delays, labour disputes, supply shortages, natural disasters, utility failures, internet outages, government actions or similar events.

18. Governing law

These Terms are governed by the laws of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

This choice of law does not deprive a consumer of mandatory protections available under the laws of their usual place of residence.

19. Severability and waiver

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision does not waive our right to enforce it later.

20. Entire agreement

These Terms, together with the Privacy Policy, Shipping & Delivery Policy, Refund Policy and any terms displayed during checkout, form the agreement between you and Roadie Merch concerning the Services.

21. Changes to these Terms

We may update these Terms to reflect changes to the Services, business practices or legal requirements. Updated Terms will be posted on this page with a revised date.

Changes will apply prospectively unless applicable law requires otherwise.
